BC Business Corporations Act

Most CAs will recall the significant changes to the antiquated BC Company Act at handed in the form of the novel Business Corporations legislation last year. Although this legislation was approved and granted Royal Assent, as with most numerous legislation, Royal Assent is not the final stage of implementation. New Auditor General's Act

Many of the changes incorporated in the updated Auditor General's Act descendant from a special task force headed up by means of past ICABC president Woody Hayes, FCA. The updated Act confirms, in legislation, practices that have evolv since the first Auditor General Act was passed in 1979; and further confirms the independence of the auditor general in as it is matters as the auditor's appointment, the approval proces for the auditor general's store access to information, and the ability to report to the Legislative Assembly. It also addresses the aim of audit coverage and audit services provided by the agency of the auditor general.

Coastal Ferry Act

This Bill create anews the BC Ferry Corporation from a sovereignty corporation into an independent Company Act company between the sides of the establishment of an authority. Ferry operators are now to be regulated through a commissioner appointed under the Bill and permanent funded by ferry operators. The commissioner is responsible for setting price caps for the ferry operators, and for reviewing and deciding forward any applications by those operators for extraordinary price cap increases, service reductions, or way discontinuances. Notably, the Coastal Ferry Act do away withs the former Crown corporation from the Auditor General's audit investigations.

Community Charter

The direction took a cautious approach to implementing the much-anticipated Community Charter through approaching the initiative in sum of two units stages. The first stage introduced this spring provides the over-arching framework for the power and responsibilities that will advance to the municipalities once the Bill is brought into force. In the fall, a next to the first Bill will be introduced to define these powers and responsibilities. As the Bill was a bit slower in coming than had been anticipated, Minister of State for the Community Charter, T Nebbling commented: "we took the time to do it right."

In the first reading debate, the Minister also noted the Bill's objective of "balancing enhanced municipal powers with increased public accountability. Local conducts will have greater autonomy to make decisions forward the delivery of municipal services. This is for the benefit of their citizens. Municipalities are in the best position to make local decisions for their citizens and for their communities. They are the even of government closest to the citizens, and the community charter thinks that. In short, municipalities can be more responsive and proactive. With the community charter, they are now active leaders in shaping the destiny of their communities. Innovative local regulations are key to a solid economic base for our entire province. stalwart local governments are key to the revitalization and economic expansion of British Columbia."

But despite the Minister's laudatory words, the business community remains disquieted that a lack of investment protection measures will undermine BC's overall investment climate. It is still unclear whether this protection will be included in the fall legislative session.

Changes to forestry legislation

In late March, Forest Minister Mike De Jong introduced a certain of the most significant changes to forestry legislation in years in three related Bills. The legislation takes back 20% of forest land held by the agency of the largest tenure holders and makes it available to just discovered players at market prices from one side public auction. The objective, in the words of the Minister, is to "open up opportunities for strange participants in both forest management and forest processing, communities, first nations, woodlot proprietors and entrepreneurs, thereby creating a more diversified and innovative forest sector that is better able to provide profession and wealth." To mitigate this reallocation of resources, the regulation provided $275 million in compensation to the forest companies and workers affected according to the changes.
