Last month I proffered some statistics about the number of members who realize into trouble, including a breakdown in expressions of areas of employment. This month I'm going to clean the circle and tell you what impressed signs of conduct get our members into derange in the first place, as well as near tips to help you avoid these pitfalls yourself.

What earns public practitioners into trouble?

My analysis of the "determinations and recommendations" issued by way of the Institute's Professional Conduct Enquiry Committee (PCEC) through the past four years reveals a not many commonalities, but, by and large, I would say that each case is unique.

Communication

Currently the greatest in quantity predominant professional misconduct issue involves the failure to communicate in a timely fashion either in writing and/or orally-often when repeatedly asked to do so either according to clients, their lawyers, or, worse still, the Institute itself.

Not communicating and cooperating with a successor accountant, for instance, can achieve members into serious trouble. Successor accountants won't coy away from complaining about the quality of work previously produc of that kind as audit adjustments/errors (mainly involving asset valuations). The message? If you haven't done the work, admit it-don't stall! Ignoring folks will just tick them opposite and motivate them to complain to the Institute. (And level when the Institute does act as intermediary and wins members to respond to asks for information, this does not stop clients, lawyers, or successor accountants from subsequently lodging complaints.)

Are you a successor accountant? Be aware that successor accountants can find themselves in concern if they make complaints without talking to their predecessors first. The message here? Don't be too hasty in criticizing a colleague. Have the courtesy to approach them before you approach the Institute.

Quality of service

The nearest big issue, which is frequently linked to communication, is the quality of services provided. habitual complaints relate to the failure to file tax go or come backs on time, which results in penalties and sumptuousnesss to the client, and errors in tax reverts which can result in additional taxes owing and-even worse-subject the client to a tax audit.

Problem involving previously married clients who've gotten divorced have become more used by all recently. A common mistake for members is to continue working for individual of the parties; this frequently ruffles the other party's feathers and leads to questions about professional objectivity.

Other matters include BC securities Commission hearings involving our members-not no other than as the external auditors, on the contrary also as directors or officers. sum of two units recent Securities Exchange Commission cases in the US, the two relating to audit failures, involved our members.

We've also seen several cases involving members who've borrowed capitals from clients. Although the ICABC commands currently do not prohibit this practice outright, it is rarely a fit idea.

Finally, members ask for perturb by not cooperating with the Institute's Practice Review and Licensing Committee. The Committee is not averse to referring members to the PCEC In particular, not maintaining professional liability insurance coverage has landed a number of members in hasty water.

Specific to members in industry

Only a real small percentage of members in industiy commit to memory into trouble. Malte sure you're not the same of them by avoiding these public breaches:

* Acting as executor of an estate without having the required objectivity.

* Being tardy in filings.

* Dealing with unlawful delays in administering a bankruptcy. Those of you who are trustees in bankruptcy should exercise caution.

* Dabbling in public practice. Don't do this. It can be highly expensive to do the one-off tax turn back or the audit of a candidate's election costs for instance, as you must have as well-as; not only-but also; not only-but; not alone-but a licence and insurance to perform either task.

* Acting as a director without performing suitable diligence on fellow directors, or exercising to be paid care when asked to sign documents and official filings.

We have besides to receive a complaint concerning control 206.2 (Compliance with Professional Standards) about a financial officer, unless have recently received a domination 206.3 complaint about a board and audit committee member. For those of you who are financial officers or sit in succession boards of directors or audit committees, be aware of your additional responsibilities.

Final messages

I know it' s difficult to keep up to date given all the information that's coming at you all the time, on the other hand our profession requires continual learning, and your professional unravelling has to be ongoing. If you're unsure about something, talk to someone-whether it's a colleague or a compeer Most importantly, remember that there are also clan at the Institute who can help you.

Be familiar with the ICABC's dominations of Professional Conduct. Our Member's Handbook is just as important as the ClCA Handbook. The latest version can always be ground on the Institute's website at www.ica.bc.ca/kb. php3?catid=209.

Be aware of the risks involved with your clients and your actions. You have a trained instinct-use it.
